Frequently asked questions

Based on hundreds of real cases — if you've asked yourself any of these, you need a legal assessment now.

The seller didn't disclose a defect — can I sue after closing?
Possibly. Ontario follows "buyer beware", but you may have a claim if the seller actively concealed a known latent defect that makes the home unsafe or unfit to live in. Limitation periods are short, so have the purchase file reviewed right away.
I'm a foreign buyer. What taxes am I really paying in Canada?
Beyond land transfer tax you may face the federal Underused Housing Tax, a provincial Non-Resident Speculation Tax, and GST/HST on new builds. We work out the full number before you commit to a purchase.
Do I still need a lawyer for a private sale between family?
Yes. Even a gift or family transfer needs a proper transfer deed, a title search and the correct land transfer tax treatment. Skipping it usually creates title and tax problems years later.
There's a problem with my title — encroachment or lien. What do I do?
Do not sign anything further. We order an updated title search, identify who registered the claim, and advise whether it can be discharged, insured over, or must be resolved before you close.
My closing was delayed — who bears the costs and penalties?
It depends on who caused the delay and what your agreement says about extensions and interest. We review the contract and correspondence to protect you from bridge-financing costs and per-diem penalty claims.
The realtor didn't represent me properly — do I have recourse?
You may. Options range from a RECO complaint to a claim for negligence or breach of fiduciary duty. Bring us the listing agreement and your communications and we will assess it.
